i'mI've been a germand IGerman freelancer for 3.5 yrsyears now and this stems from the discussion with my tax consultant (steuerberater) at the time:

in GER itIn Germany, qualifying as a "freiberuflerit" depends on several factors if you may qualify as a "freiberufler":

  1. uYou need to have an academic degree, i.e. Dipl./Ing. or such.
  2. theThe job uyou are doing must be in that line and be of consulting or engineering quality.
  3. uYou cannot trade goods, i.e. buy and sell with the intent to make gainprofit.

howeverHowever, even if all of these are met, uryour safest bet is that uryour local tax office (finanzamt) that will do uryour taxes approves that uyou qualify as freelance b/c pointa freelancer. Point 2. has some flexibility, especially if uyou are a foreigner and cond.point 1. is not met with a germanGerman degree.

so iSo I advise to contact a germanGerman tax consultant (close to where uyou will work that can easily contact the tax office) and discuss the matter with him||herthem.
